Agreement

These terms govern your use of this website and, together with any signed proposal or service agreement, our provision of services. If a signed agreement conflicts with these terms, the signed agreement controls.

Services and scope

Services are described in your proposal or statement of work. Work outside that scope requires a written change order and may carry additional fees.

Timelines depend on your timely delivery of access, assets, approvals and information.

Fees and payment

Setup fees are due before build work begins. Monthly fees are billed in advance.

Refunds and cancellations are governed by our Refund and Cancellation Policy, linked below. In short, work that has not begun is refundable, and after work begins we keep only the amount earned for completed work plus documented committed costs.

Ad spend is paid by you directly to the advertising platforms and is not included in our fees.

Third party software, subscriptions and usage based charges, including call minutes, SMS, AI usage, hosting and tooling, are your responsibility.

Travel, actors, talent, studios, locations, permits, props, licensed music and other major production costs are quoted and billed separately.

Late payments may pause services. Recurring invoices may incur reasonable late fees where permitted by law.

Term and cancellation

Unless a signed agreement states a different initial commitment, ongoing engagements run month to month. A cancellation received before the next billing date stops the next renewal, and service continues through the period already paid for.

Where a signed agreement sets an initial term, that agreement controls the notice period.

The Growth System Audit is a one time purchase. Its fee is credited toward a setup fee if a service agreement is signed within 14 days of delivery.

No guarantees

We do not guarantee rankings, traffic, lead volume, appointment counts, conversion rates, return on ad spend or revenue. Any projections are estimates based on available information, not promises. Results depend on your offer, pricing, sales execution, market conditions and platform behavior outside our control.

Client responsibilities

You are responsible for the accuracy and legality of the information, claims, testimonials and materials you provide, and for compliance with laws applying to your industry, including advertising, healthcare, financial, telemarketing, recording consent and messaging regulations.

You are responsible for maintaining your own ad, CRM, hosting and telephony accounts and for the charges they incur.

Ownership and licenses

You own your accounts, data, domains and the final deliverables produced for you, once fees due have been paid.

We retain ownership of our preexisting methods, templates, tooling and internal systems, and may use nonconfidential work in our portfolio unless you ask us in writing not to.

Confidentiality

Each party will protect the other's confidential information and use it only to perform under the agreement.

AI assisted services

Some services use AI systems for answering calls, chat, qualification, scheduling, summarization and follow up. AI output can contain errors. You are responsible for reviewing scripts, rules and disclosures before launch, and for the resulting communications with your customers.

Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages. Our total liability for any claim is limited to the fees you paid us in the three months preceding the claim. Services are provided on an as is basis without implied warranties.

Changes and governing law

We may update these terms; continued use of the site or services indicates acceptance. These terms are governed by the laws of the state in which we are organized, without regard to conflict of law rules.

Full detail lives in our Refund and Cancellation Policy. Where these terms and that policy describe the same subject, the policy is the detailed statement and these terms are read together with it.
